1. About These Terms
These Terms and Conditions ("Terms") govern your use of the My Migraine Coach website (mymigrainecoach.com.au) and any programs, content, or services purchased through it, including the Free 5-Day Reset and Raise Your Threshold (together, the "Services").
The Services are operated by Melissa Macdonald, trading as My Migraine Coach, a sole trader based at 5/8 Coronation Avenue, Pottsville, NSW 2489, Australia ("we," "us," "our").
By accessing this website or purchasing any program, you agree to these Terms. If you don't agree, please don't use the Services.
2. Not Medical Advice
The content provided through My Migraine Coach, including the Free 5-Day Reset, Raise Your Threshold, blog content, and any other materials, is general educational and lifestyle information only.
It is not personalised medical advice, diagnosis, or treatment, and does not create a doctor-patient or therapist-client relationship.
You should always consult your doctor, neurologist, or other qualified healthcare provider regarding your individual health circumstances, before making changes to your migraine management, medication, or treatment plan.
If you are experiencing a medical emergency, call 000 (Australia) or go to your nearest hospital emergency department immediately.
We do not accept responsibility for any outcomes resulting from your use of, or reliance on, the information provided through the Services.
3. Purchases and Payment
All prices listed are in Australian Dollars (AUD) and include GST.
Payment is processed securely through Kajabi's payment system at the time of purchase.
By purchasing Raise Your Threshold or any other paid program, you agree to pay the listed price in full.
4. Refund Policy
Raise Your Threshold provides instant, full access to all program content (8 weeks of material) immediately upon purchase.
Because of this instant and complete access, we do not offer refunds for change of mind.
We encourage you to read the program description, FAQ, and any available preview content carefully before purchasing, and to contact us with any questions beforehand.
If you believe there has been a genuine issue with your purchase, for example, a technical fault preventing your access to the program, or the program being materially different from how it was described, please contact us at [email protected] and we will work with you to resolve the issue.
Nothing in this policy affects, limits, or excludes any rights or remedies you may have under the Australian Consumer Law, including the consumer guarantees that apply to goods and services, which cannot be excluded by these Terms.
5. Access and Use of Programs
When you purchase Raise Your Threshold, you receive a personal, non-transferable licence to access the program content for your own individual use.
You may not share your login details, resell, redistribute, or publicly share any program content, including videos, worksheets, or written materials, without our prior written consent.
We aim to provide ongoing access to purchased programs, but reserve the right to update, modify, or discontinue content from time to time.
If a program is discontinued entirely, we will provide reasonable notice where possible.
6. 1:1 Consultations
Optional 1:1 Zoom consultations offered as an add-on within Raise Your Threshold are bookable directly through Kajabi's scheduling tool.
These sessions are educational and coaching in nature and do not constitute clinical physiotherapy treatment or replace the services available through Pottsville Physiotherapy or any other registered healthcare provider.
7. Intellectual Property
All content provided through My Migraine Coach, including but not limited to written materials, videos, worksheets, the "Raise Your Threshold" name and program structure, and the "Beyond Headaches" name, is the intellectual property of Melissa Macdonald / My Migraine Coach and is protected by copyright.
You may not copy, reproduce, distribute, or create derivative works from this content without prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law, we exclude all liability for any indirect, incidental, or consequential loss arising from your use of the Services.
Where Australian Consumer Law implies guarantees or rights that cannot be excluded, our liability is limited to the extent permitted by that law.
9. Changes to These Terms
We may update these Terms from time to time.
Continued use of the Services after changes are published constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the jurisdiction of the courts of New South Wales.
